When importing certain types of goods into the territory of the EAEU (or exporting from it), in particular, into the territory of the Republic of Kazakhstan, it will be necessary to obtain permits confirming compliance with prohibitions and restrictions in the field of non-tariff regulation.

Notification

Notification is the most common document issued when importing/exporting goods containing encryption functions. The notification is submitted by the applicant to the coordinating authority (National Security Committee of Kazakhstan), registered by the latter, and allows any foreign trade operators (as well as individuals) to import goods in any quantity and for any purpose.

Power of attorney from the manufacturer is required to submit documents for registration of notification. The power of attorney must be drawn up taking into account current requirements, signed by a duly authorized employee of the manufacturing company, certified by a notary public and, if necessary, legalized (apostilled).

Licence

If the equipment performs complex (“strong”) data encryption, or the importer does not have the opportunity to provide an apostilled power of attorney for notification, a Licence for the import (export) of encryption tools issued by the Ministry of Industry and Infrastructure Development of the Republic of Kazakhstan is required for import (export).

It should be borne in mind that in order to issue this document, it is necessary to have a valid Permit of the National Security Committee for sale of encryption tools.

Conclusion report on non-classification as CIPF

In some cases, a product may be included in the list of encryption tools both by code and name, but not have encryption functions. In this case, a technical examination is carried out to classify the goods as means of cryptographic protection of information (encryption tools) and the authorized body — the National Security Committee — issues a conclusion.

It is determined on the basis of technical characteristics, CN FEA code and purpose of import which document needs to be submitted to customs.

Conclusion report for import, export or transit

A conclusion report (permit) is issued in case of temporary import (export) of cryptographic tools/CIPF, or their import for own needs without the purpose of resale or transfer to third parties.

The conclusion report is issued by the National Security Committee of Kazakhstan, in the name of a specific importer (exporter).

Radio electronic equipment and high-frequency devices (RE equipment and HF devices)

Radio electronic equipment (RE equipment) is the equipment designed to transmit and (or) receive radio waves, consisting of one or more transmitting and (or) receiving devices, such as:

High frequency devices (HF devices) are equipment or devices designed to generate and use radio frequency energy for industrial, scientific, medical, household or other purposes, with the exception of applications in the field of telecommunications. For example:

Conclusion report

A conclusion report can be issued in case of temporary importation of RE equipment and HF devices, transit, or as an intermediate document for issuing a Licence. The conclusion report is issued by the authorized body — the Telecommunications Committee of the Republic of Kazakhstan.

Licence

The licence is issued in case of import (release for domestic consumption) of RE equipment and HF devices. The licence is also issued by the Telecommunications Committee of the Republic of Kazakhstan.

Toxic substances and pesticides

Plant protection products (pesticides)

Plant protection products (pesticides) are chemical and (or) biological preparations (insecticides, rodenticides, fungicides, herbicides, anti-emergence agents and plant growth regulators, defoliants, desiccants) used for pest control and to combat plant diseases, weeds, pests of stored agricultural products, as well as for seed dressing, pre-harvest drying, leaf removal and plant growth regulation.

Toxic substances

These are potent substances that are not narcotic drugs, psychotropic substances and their precursors (arsenic, metallic mercury, nicotine, sodium cyanide, etc.).

Licence

In order to import plant protection products (pesticides), a licence must be submitted to the customs authorities. The licence is issued by the State Inspection Committee in the Agro-industrial Complex of the Ministry of Agriculture of the Republic of Kazakhstan. It should be borne in mind that in order to get this document, you must have a valid licence for the production of pesticides (toxic chemicals), the sale of pesticides (toxic chemicals), the use of pesticides (toxic chemicals) by aerosol or fumigation methods.

Licence

A licence is required when importing toxic substances. The licence is issued by the Industrial Development Committee of the Ministry of Industry and Infrastructure Development of the Republic of Kazakhstan. When issuing an import licence, the importer must have a licence to carry out activities with toxic substances.

Human biological materials

Import and export of human biological materials is carried out on the basis of permits.

For the purposes of issuing permits, biological materials are divided into three groups:

Licence

A licence needs to be issued in order to import (export) biological materials to and from the territory of Kazakhstan, a. The document is drawn up by the authorized body — the Committee for Medical and Pharmaceutical Control of the Ministry of Health of the Republic of Kazakhstan.

Narcotic drugs, psychotropic substances and their precursors

Narcotic drugs, psychotropic substances and their precursors are substances of synthetic or natural origin, preparations subject to control in accordance with the Single Convention on Narcotic Drugs of 1961.

Licence

A licence must be issued for the import or export of narcotic drugs, psychotropic substances and their precursors, plant protection products (pesticides). The licence is issued by the Ministry of Internal Affairs of the Republic of Kazakhstan. In the case of export, you will need to submit a copy of the authorization of the competent authority of the importing State for the importation of controlled substances, if required by law, or an official notification from said authority that such authorization is not required.

Dual-use goods

According to the general definition, dual-use goods are products that can potentially be used both for civilian and military applications.

Conclusion report

In some cases, the customs inspector needs to make sure that the product does not belong to dual-use goods. In such case, a Conclusion Report on classifying goods, technologies, works, services, information as dual-use products is drawn up. If the conclusion indicates that the product belongs to dual-use goods, after all, a licence is unavoidable.

Licence

A licence is issued when importing or exporting goods subject to export. The licence is issued by the Industrial Development Committee of the Ministry of Industry and Infrastructure Development of the Republic of Kazakhstan.
